An extension of Medicare telehealth flexibilities through December 31, 2027
A five-year extension of the Acute Hospital Care at Home Program through September 30, 2030
An extension of in-home cardiopulmonary rehabilitation flexibilities through January 1, 2028
A requirement that HHS issue guidance within one year on furnishing telehealth services to individuals with limited English proficiency
Inclusion of virtual diabetes suppliers in the Medicare Diabetes Prevention Program through December 31, 2029

CMS Updates Telehealth Frequently Asked Questions
The Centers for Medicare and Medicaid Services (CMS) updated their latest telehealth frequently asked questions in alignment with the two-year extension – noting that CMS will continue to pay telehealth claims the same way they had been paid before October 1, 2025.
ATA Action will be submitting comments on a CMS proposal to exclude diagnoses from audio-only telehealth services from MA risk adjustment model calibration, urging reconsideration and a modality neutral approach. CMS believes audio-only encounters do not satisfy the face-to-face standard.
Letter of Support for CMMI Access and FDA Tempo Models
ATA Action submitted a letter to the Centers for Medicare and Medicaid (CMS) and the Food and Drug Administration (FDA) expressing strong support for the new CMMI ACCESS and TEMPO innovation models, seeking clarity and improvements, as well as recommendations and questions, aiming to help make these models practical, financially viable, and attractive to a broad range of stakeholders while advancing patient-centered, technology-enabled care.
HHS ONC/ASTP Office Annual Meeting
The Assistant Secretary for Technology Policy (ASTP)/Office of the National Coordinator for Health IT (ONC) is hosting their annual meeting in Washington, DC, February 11-12. ATA CEO Kyle Zebley is joining a panel discussion, “Making America Healthy Again Through Technology + Care,” exploring how technology is blurring the line between daily life and clinical care, empowering patients to manage their own health. Activity Around AI in Healthcare Bills of Interest
Two bills of interest in Illinois: A bill to amend the restrictive AI Therapy Bill from last session has been introduced (HB5003), and ATA Action hopes to secure further amendments. New legislation regarding the use of AI in nursing (H4804) outlines a series of tasks AI cannot perform.
In Hawaii, ATA Action submitted written testimony for SB 2281 raising concerns with unworkable requirements in the bill.
Emergency Licensure Flexibility Legislation Introduced in Hawaii
HB 2558/SB 3192 would allow physicians, licensed and in good standing in another state, to provide telemedicine services to Hawaii patients if the service is not reasonably available in Hawaii and a state of emergency has been declared.
NM Considering Legislation Establishing Out-of-State Telehealth Provider Registration System
New Mexico is considering legislation (HB 127) to establish a telehealth registry, allowing out-of-state licensed providers in good standing to provide telehealth care to NM patients if they register and pay necessary fees, without full NM licensure. The bill passed the House and Human Services Committee, and ATA Action submitted a letter in support.
Michigan Pay Parity Legislation Introduced
SB 722 introduced in Michigan would require insurers to provide at least the same coverage at the same rate for telemedicine services as for in-person care.
