    FEDERAL POLICY UPDATES

    Congressional Action Gears Up

    This week, Members of Congress are expected to reconvene in advance of the President’s State of the Union address on February 24, and discussions are likely to resume around appropriations and the broader FY 2026 funding process. Committee hearings and markups are also anticipated, as both chambers try to build momentum on funding and other legislative priorities. 

     

      ATA Action to Lead on Special Registration Framework for Remote Prescribing of Controlled Substances

      In a meeting with the White House Office of National Drug Control Policy (ONDCP), ATA Action emphasized the need for a permanent pathway for remote prescribing of controlled substances and the critical role telemedicine plays for rural populations. ONDCP requested that ATA Action draft a policy memo on a special registration framework the agency can champion internally. Next steps include preparing materials, rallying coalition support, connecting ONDCP with technical experts, and holding a follow‑up meeting with ATA Action Advocacy Ally members to refine our proposal. 

       

        ATA Action Urges Unified Framework for Clinical AI
        ATA Action’s comment letter urges the Department of Health and Human Services (HHS) to establish a unified federal framework for clinical artificial intelligence (AI) with clear, outcome focused standards, Food and Drug Administration (FDA) boundaries, safe harbors, and shared accountability among developers, deployers, and clinicians. Our comments highlight real world performance, continuous monitoring, and reimbursement models like ACCESS that capture the actual cost and clinical value of AI tools. 

         

        We thank ATA Action members for their thoughtful input, which strengthens our collective voice in federal policy discussions.

            State Policy Updates

            ATA Action Opposing Restrictive Medicaid Changes for Out-of-State Provider Enrollment in FL  

            Proposed changes to Florida’s Medicaid Manual would largely prohibit out-of-state providers to serve Medicaid beneficiaries. ATA Action is submitting testimony opposing these changes as part of a hearing on March 2. We encourage affected members to do the same.

             

            NJ Ends Temporary Waiver on Remote Prescribing of Controlled Substances

            A temporary emergency order allowing New Jersey providers to prescribe Schedule II controlled dangerous substances via telemedicine expired on February 16. Further details can be found here. 

             

            Corporate Practice of Medicine (CPOM) Bill in Washington State Fails to Advance

            ATA Action has successfully opposed an effort in Washington State to impose impractical PC-MSO (Management Services Organization/Professional Corporation) mandates, which will not advance this session.

             

            Illinois Bill With Potential Consequences for RPM has First Hearing

            ATA Action and a number of other stakeholders submitted testimony against Illinois HB 4331, which would amend the Consumer Fraud and Deceptive Business Practices Act and potentially have negative consequences for reimbursement for RPM.
